"...that as a result of an inspection at my own request of my weight
loss medical facility located in Dallas and my progressive approach
to the threatment of obesity through the use of my website at
absolutelythin.com and the Internet that the representative of the Drug
Enforcement Administration demanded that I immediately surrender
my Drug Enforcement Administration License.

She told me that I was in violation of Federal Law and I was given by her two
choices:

1. Surrender my Drug Enforcement License Immediately
2. If I did not surrender my Drug Enforcement License immediately
that she would bring the full power of the United States Government
to bear against me in a Federal Lawsuit and that I would face up
imprisonment in federal prison up to five (5) years.

As a result of her threats and my lack of rersources to fight the federal
powers that she represents I chose to voluntarily surrender my DEA license.

This means that I will no longer be able to provide you with treatment
for your over weight problems (or other medical problems in which I
would need to be licensed by the Drug Enforcement Administration)
effective immediately.

I retain my medical license and my future plans are up in the air at present,
but I have several other medical opportunities that I will explore
as well as several non-medical opportunities and I will keep you informed
as I make my decision (s) about my medical and non-medical future plans
which include other possible services (some medical and some non-medical) that
I plan to offer that may be of service to you.

As you can imagine this comes as a tremendous shock and loss to
me and to my medical staff.

I want to tell you what a privilege it has been for me and my staff
to be able to treat you for your overweight problem for the past eight
years and I hope that we have been able to provide you with guidance
and help in overcoming your overweight problem.

I urge you to follow my recommendations to learn to eat less
and to make it a habit so you can attain a normal and healthy body weight
and then to be able to retain it to improve your health and to live
a long, healthy, and joyful life.

I find the decision at great odds with the reality of our national
obesity problem and the fact that in eight years and treating over
7,500 patients through our website at www.absolutelythin.com that
we have had great success in helping our patients and that we have
never harmed anyone.

My inability to prescribe DEA controlled substances is effective
immediately and according to the DEA official irrevocably.

I took issue with her allegations with which I did not agree, but I
do not have the resources to fight the full powers of the U.S. Government.

The official never looked at or considered a great deal of information
that I had gathered in advance of our meeting that support what
was in my opinion a perfectly legitimate, effective. and innovative
medical approach to helping solve our national obesity epidemic
with which we have had great success.

I wanted to thank all of you who took the time to write supportive
emails regarding your experience with our service and how gratifying
(and very thoughtful) I regard all of your positive and supportive
comments regarding our on-line medically supervised weight loss
service.

In the two days since I had emailed my request for your help I had printed
out in excess of 500 or so of your responses (as well as a great deal of
additional medical and scientific information) that would support the
basis of our methology for treating obesity.

She and her assistant never bothered to review a single page of the
material I provided to her which included copies of your emails all
of which I found very thoughtful and touching.

It has been a privilege serving you and I will keep you informed
as to my future plans and activities if I feel they might be of benefit
to you.

Best Wishes to You for a Long, Healthy, and Joyful Life.

Sincerely Yours,

Dr. B

P.S.

As a result of the DEA officials decision we will no longer be able to continue
our weight loss service to you effective immediately.

It will take us several days to inactivate our website at absolutelythin.com.

Please do not Register as a new patient or submit progress notes for
medication refills as I am no longer able to treat you in the present form.

Anyone who has completed a request for an on-line consultation paid my fee
in the meantime since this decision today ( July 15, 2008) will receive a full
refund, but it will probably take several days to complete this in an orderly
fashion.

Please be patient and we will complete this for you ASAP (I estimate
within one week or so).

Thank you again for the privilege of being able to serve you.

Best Wishes,

Dr. B

I also received this email. Appears as though Dr. B has been shut down for good. It's very unfortunate, as he was a great Doctor who helped many people. He has done wonders for me and hundreds of others, and now is put out of business.

It's truly ashame.

People are forced to order online, from other countries, etc...just like it was before Dr. B was there. No different. Like anything else that is hard to get or find, when there is a will there is a way. Yes its very unfortunate as I have not read where anyone was harmed by the drugs Dr. B prescribes.

this is true but the price that I got my meds from Dr. B was a heck of a lot cheaper then the price that I could get them from any where else. And when you are on a tight budget, every little bit counts!!!

 I feel so sorry for Dr. B. Of course, he's probably not destitute, but he *is* out of a job that he clearly loved and was very good at. I can't imagine waking up one morning and everything I had ever known had completely changed and would never be the same again. What about the people who worked for them? They're probably out of work now, too.

I'm not usually one for conspiracy theories, but I firmly believe the pharmaceutical companies are the reason behind the general crack down on phentermine in the past few years. Why would they want the public to have access to a reliable and affordable weight loss medication that costs just pennies per pill (because the patent has looooong since expired) when they stand to make MUCH more money off of patented prescription meds like Meridia, not to mention all the revenue gained from treating obesity-related illnesses like diabetes, heart disease, hypertension, etc?!?! The pharmaceutical companies OWN the FDA and DEA.

I'm a big girl — I don't need Big Brother keeping me "safe" from myself.

This really sucks...but I guess I kind of knew it was coming when I got the call from that stupid lady!! I was doing, like most of you, doing soo well.....I have been going since the end of January of when I started and I am so sad. So now, I guess we are back to ordering from other countries, not knowing what we are really getting.....The DEA sucks too!!!! This must have been going on for awhile for them to shut down so quick. Oh well, what could you do...it is what it is and there is nothing more we can do about it.

This sucks man. I want to know who this "she" in question is and go kick her f*cking teeth in. I hope she feels good about being a puppet for the pharmaceutical companies, because that's all she is. A lame puppet who can't think or act for herself or for anything in a patient's best interest. Ya know? Grrrr. :x

And poor Dr. Branch  -- he is nothing more than a good man and a good doctor trying to help people (and was doing so successfully until all of this came down on him and his those working in his office.. bless their hearts!)

He wasn't doing anything malicious. He wasn't operating a crack shack in the "bad part of town" or selling drugs illegally. He was simply taking the steps he felt he needed to take to rightfully prescribe weight loss medicine to those who needed it but weren't into paying $400 per bottle.

He wasn't contributing to ANYTHING that the DEA SHOULD even have an interest in (aka, the war on drugs...crack and heroine on the streets... gangs etc.). Makes me wonder where my tax dollars are going when I see the DEA "cracking down" in this fashion, but then I see multiple drug deals (yes, with my own eyes) going down several blocks from my city apartment and nobody doing a damn thing about it. Hmmm... interesting.

I used Dr. B for a few months last year, but was unable to afford it so I had to stop. I too am upset about this I don't understand every doctor that I have talked to has told me the same thing that Phentermine is a class C drug and as long as I don't have high blood pressure it won't hurt me to take it. This has to be about control and money not about our safety.

I actually live in Texas and I am now going to a local weightloss clinic weekly that gives me phentermine, but I wouldn't be suprised if they started shuting down all of these too.

I get a week supply of Phentermine and two shots to help boost my metablosim and burn of inches faster. I started at 159 LBS (thanks to taking Phentermine before from Dr. B I was 189 lbs) and in one month I am now down to 143 lbs I have never had any problems with phentermine in fact I think drugs like Benadryl are alot worse on you then Phentermine.

Some how we need to take a stand against the FDA I no that seems crazy but they are trying to control our lives isn't this a free country?

What do you guys think about this -- it says he'll provide a refund if you've filled out a progress note since the decision date (July 15). Well, I filled one out on July 11... Friday. They said (before this decision came and all) that it would be called in yesterday (Tues) or today (Wed). I'm wondering what is going to come of my prescription?

He didn't refer to anyone getting refunds if they filled progress reports BEFORE the decision date... does this mean we're getting our Rx's still?

I know this kind of seems rude to ask given the events of late and all, but I still need to know if I'm going to get my last RX or a refund.... what do you guys think?

You will probably get a refund.

It's small consolation considering how many people are negatively affected by this travesty of justice; however, I think we can safely say...

What goes around, comes around.

Everyone who "reported" Dr. B. to the TMB — from the pharma-nazis berating customers for bringing in scripts from an out-of-state doctor to the one(s) on here cheering for his downfall and crowing about the "illegality" of his practice — you reap what you sow. And, you will get back what you've given tenfold. Someday, somehow.

Stanbo said it best on another thread, "Bitch, meet Karma."

I think you're well within your right to ask. You've spent the money, after all. Since you're so close to the cut off date he put in the email I would just call his office and politely ask them. I would think someone would still be there to answer your question (I hope). I'd be a little nervous going to the pharmacy without talking to his staff first, but that's just me!

Damn government.....why don't they turn their attention to some of the more pressing issues? This stinks for Dr. B. I hope he will be OK. An MD without a DEA license will be hard pressed to practice when he can't prescribe. Well, if the DEA comes knocking at my door (figurativley speaking, of course) bring it on. Bastards.
